The 2019 Fall Cardone Tech Video Contest (the “Contest”) is a video submission contest sponsored by Cardone Industries, Inc. (“Sponsor” or “Cardone”). Each Video Submission must feature the installation of, or service on a vehicle of any under-the-hood or under-the-vehicle automotive part. The winner of the Contest will be determined by public voting managed within the Contest web site platform https://videocontest.cardone.com (“Web Site”). One winner will receive $5,000.00 USD.
The Contest is open to legal U.S. residents or Canadian residents over the age of 18, except residents of Quebec. To enter, you must be: i) a legal resident of the U.S., Canada, D.C., Guam, Puerto Rico, the U.S. Virgin Islands; and ii) 18 years of age or older (19 in Alabama or Nebraska) at the date of submission (the “Entrants”). The Entrant will be deemed to be the person who is the owner of the email address used in the entry form. Void where prohibited.
Employees, officers, directors, contract workers and shareholders of Sponsor, its affiliates, subsidiaries, advertising, promotion, fulfillment or other coordinating agencies, and employees, officers, directors, contract workers and shareholders of Sponsor’s affiliates and subsidiaries, , members of any of their immediate families, and those living in the same household, are ineligible.
Entry constitutes Entrant's certification that he/she meets the eligibility requirements set forth in these Official Rules. Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Participation and entry into the 2019 Fall Cardone Tech Video Contest constitutes Entrant’s full and unconditional acceptance of these Official Rules. In the event of any discrepancy, the Official Rules will prevail. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
Sponsor may cancel or amend the Official Rules without prior notice. Any changes will be posted within the Official Rules. The Official Rules were last updated September 19, 2019.
Contest Entry Period
This Contest begins on Tuesday, October 1, 2019 at 12:00:00 a.m. Eastern Daylight Time (“EDT”) and ends Friday, February 14, 2020 at 11:59:59 p.m. Eastern Standard Time (“EST”) (the “Contest Period”).
- The Web Site is the official clock for this Contest.
- All entries must be entered into the Contest during the Contest Period.
- All entries must be received by Sponsor prior to the expiration of the Contest Period.
Entries must be received by Friday, January 31 at 11:59:59 p.m. EST. Voting will end Friday, February 14, 2020 at 11:59:59 p.m. EST. Notification of winner will be provided to Entrant via the email provided by Entrant in the entry form on the Web Site.
How to Enter
Entrants may register for the Contest by visiting http://videocontest.cardone.com during the Contest Period, completing the online entry form, and uploading an original video showing the installation of or service on a vehicle of any under the hood or under the vehicle automotive part (“Video Submission”). For example, the video may show the installation of or service on a vehicle of a drivetrain, suspension part, solid engine part, or brakes. Proof of submission will not be deemed to be proof of receipt by Sponsor.
Video Submission Requirements:
- Created using most digital cameras, camcorders and mobile phones in .AVI, .MOV, .WMV, and .MPG file formats.
- All entries must be entirely original to the Entrant.
- The entry may feature one or more people in the Video Submission.
- Any and all audio in the Video Submission must be in English.
- Entrant has secured all rights, permissions and licenses necessary from parties appearing or speaking in the Video Submission to grant Sponsor the rights granted in the Official Rules.
- Entrant must keep a digital or hard copy of their Video Submission. If required, Entrants must supply the original recording of their video entry for use in connection with the Contest, including (but not limited to) potential broadcast online or transmission by any electronic means.
Videos Submissions must NOT:
- Contain material that violates or infringes another's rights, including but not limited to material that violates privacy, publicity, intellectual property or moral rights, or that constitutes copyright infringement.
- Contain defamatory, obscene, offensive, profane, or malicious content.
- Contain poor audio or visual quality.
- Include music, singing, trademarks, logos, insignia, location signage, sculpture, posters, pictures, photographs or other artwork, music tracks, snippets of copyrighted programs, or films made by other users, without the requisite authorizations. All music featured in any video must be available to publicize and broadcast on a license-free, no compensation basis.
- Include any type of endorsements, including but not limited to audio or visual endorsement of any kind of tools, vehicle parts, repair shops, business or company.
Sponsor is not responsible for lost, late, illegible, invalid, misdirected, or incomplete entries, all of which will be disqualified. BY SUBMITTING THE ORIGINAL ENTRY, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE, AND INTEREST NECESSARY TO GRANT THE RIGHTS GRANTED HEREIN AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY.

Rights in Submissions
Sponsor does not claim any ownership rights in or of the Video Submissions, including, but not limited to, intellectual property rights, rights of publicity, privacy rights, recorded performance and moral rights therein.
By entering the Contest, the Entrant hereby grants to the Sponsor, its affiliates and assignees, a worldwide, exclusive, irrevocable, royalty free, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display such Video Submission, or any portion thereof, in any media now known or hereafter devised including, but not limited to all forms of television and all forms of Internet and wireless protocol. Each Entrant authorizes the Sponsor, its shareholders and any entities affiliated or in privity with the Sponsor to utilize, for eternity and in any manner they see fit, the Video Submission submitted to Sponsor, and to make derivative works from such materials for commercial purposes (such as advertising, trade and promotional purposes). Each Entrant releases the Sponsor, its shareholders, affiliates, and each of their assignees and licensees, from any and all claims or liability (now known or hereafter arising), including but not limited to any claims for defense and/or indemnity, in connection therewith. Each Entrant agrees and acknowledges that participation in the Contest, including, without limitation, the Entrant's decision to provide the Entrant's submission to Sponsor for purposes of the Contest, shall not give rise to any confidential, fiduciary, implied-in-fact, implied-in-law, or other special relationship between Sponsor and Entrant, does not place the Sponsor in a position that is any different from the position held by members of the general public with regard to elements of the Entrant's Video Submission, and that the only contracts, express or implied, between the Sponsor and Entrant are as set forth in these Official Rules and any and all related release forms. The winner may be required to complete and execute additional documents and have third parties execute Sponsor's documents in connection with the rights granted to Sponsor as a condition of prize acceptance. In addition, by participating in the Contest and submitting a Video Submission, each Entrant hereby grants permission (except where prohibited by law) for the Sponsor to use Entrant's Video Submission, name, likeness, voice, quotes, comments, biographical information, photograph and/or image for the purpose of advertising, trade, or promotion without further notice, permission, compensation or consideration in any and all media now known or hereafter developed throughout the universe, unless prohibited by law.
Eligibility of Entries
The Sponsor will be the sole judge of whether Entries are valid and eligible Entries, and the decisions of the Sponsor will be final in all respects. Sponsor has five (5) business days to review each Video Submission for compliance with the Official Rules before posting to the Web Site for Public Voting. Duplicate Video Submissions will not be accepted.
All Video Submissions will be subject to moderation. Sponsor and/or its agents have absolute discretion to accept or reject any video entry and to remove any video entry already accepted without giving reasons for the decision.
Video Submission Voting & Judging
Public voting on the Web Site will determine the top 5 entries to move on to the judge’s round. The public voting will be open during the Contest Period on the Web Site. Any member of the public may vote online once every 24 hours. Voting is free; however, voters may be subject to standard internet charges or data charges if voter is using a web browser on a mobile phone or other device.
The Contest platform will utilize a system that counts each unique vote (to counter vote fraud). The public votes will be tabulated using a 10 points per vote system. The tabulation will NOT be visible to the public. The top 5 entries with the most Public Votes will move on to the judge’s round. In the event of a public vote tie between Video Submissions, all tied Video Submissions will be allowed into the judge’s round.
Sponsor reserves the right to disallow votes if it has reasonable grounds to suspect that fraudulent votes have been cast (i.e. more votes than a human being could possibly submit in the time available without the use of software or other devices designed to make automated votes). Sponsor reserves the right to disqualify any finalist who engages in activity which could be designed to unfairly manipulate the outcome of the public vote.
During the judge’s round, the winner will be chosen by Sponsor via a panel of 5 Cardone ASE-Certified technicians and trainers. Entries will be judged on three equally-weighted categories as set forth below with each panel member assigning 1 to 10 points for each category:
The points awarded by each panel member will be added together. The Video Submission with the highest number of points awarded by the panel will be selected by Sponsor as the winner. In the event of a tie among Video Submissions during the judge’s round, all tied Video Submissions will be entered in a final round. All public vote points will be cleared and each panel member will cast a single vote for a winner.
One winner will receive $5000.00 USD (the “Prize”). The total approximate retail value of the Prize is $5,000.00 USD.
The winner acknowledges that the Prize is non-transferable and is not redeemable for or any other value or consideration.
Sponsor reserves the right in its sole discretion to substitute the Prize in whole or in part with one of comparable value. Recipients are solely responsible for any and all taxes on the Prize. All costs and expenses associated with the Prize acceptance and use not specifically provided herein are the responsibility of the recipient. Winner may be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.
Winner may be required to complete, sign, and return an Affidavit of Eligibility/Liability Release/Publicity Release (granting the use by Sponsor of his or her name, city/state, likeness, or photograph for advertising/publicity purposes, without further compensation), except where prohibited by law. Sponsor is not responsible for any change of Entrant mailing address, email address and/or telephone number. In the event of non-compliance with these Official Rules, or if a Prize notification or Prize is unclaimed or returned as undeliverable, the Prize will be forfeited and an alternate recipient may be contacted.
The winner must be available to take part in interviews and/or any other promotional materials and/or events if requested by Sponsor. In the event that the winner is not available when required, Sponsor reserves the right, in its absolute discretion, to select an alternative winner.
Sponsor may in its sole discretion refuse to provide the Prize, or seek its recovery, in the event of non-entitlement under these Official Rules or an Entrant's breach of these Official Rules, fraud, dishonesty, or other inappropriate or improper conduct.
The winner will be contacted via the email provided in the entry form on or about February 21, 2020. The winner will be required to respond to the email notification within 5 days of the date of the email notification. If the winner does not respond within 5 days, Sponsor reserves the right to select an alternate winner.
The details of the winner will be posted on http://www.cardone.com within 5 days after the winner claims the prize and no later than February 28, 2020.
Collection of Personally Identifiable Information
Entrants will be provided the opportunity to opt-in to receive news, information and advertisements via email from the Sponsor in which case the Entrants PII will be used for this purpose.
RIGHTS OF SPONSOR / DISCLAIMER OF LIABILITY
Sponsor shall have the right and sole discretion to edit, to refuse to air or transmit, or cease to air or transmit any Video Submission whatsoever which it finds to be in violation of these Official Rules, or which it finds in its sole discretion to be otherwise objectionable for any reason, including with respect to Sponsor's standards and practices and other policies. Sponsor also reserves the right to replace the winner's Video Submission with the Video Submission of an alternate eligible Entrant in accordance with these Official Rules if such Video Submission and/or Entrant is withdrawn from or removed from the Contest for any reason, including without limitation, Entrant's failure to have Sponsor's documents executed by any third party (such as contributors or participants). Sponsor also reserves the right, in its sole discretion, to terminate the Contest for any reason in the event that there is an error, malfunction, problem or other cause which impacts the operation, administration or security of the Contest or the Sponsor and, in such situation, to select the winner(s) from the eligible Entries received prior to the action taken or in such manner as deemed fair and appropriate by Sponsor. The Sponsor is not responsible for any materials provided by Entrants which are deemed harmful or offensive to others or for any harm incurred as a result of the Video Submission's creation. The Sponsor is not responsible in any way for any injury, loss or damage which occurs as a result of the creation of the Video Submission, an opinion expressed or information provided in the Video Submissions transmitted on the website or on television. The Sponsor makes no warranties, express or implied, as to the content or the accuracy or reliability of any information or statements contained in the Video Submissions.
Sponsor is not responsible for the content or practices of You Tube, Facebook, Google or other third party websites that may be linked to the Contest. The Contest is not endorsed, sponsored or affiliated with You Tube, Facebook or Google in any manner. This site may also be linked to websites operated by companies affiliated with Sponsor. Visitors to those sites should refer to each site's separate privacy policies and practices.
Entrant shall fully indemnify, hold harmless and defend Cardone and its directors, officers, employees, agents, shareholders and affiliates (each an “Indemnified Party” and collectively, “Indemnified Parties”) from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs and expenses, including but not limited to reasonable attorney’s fees and costs, whether or not involving a third party claim, which arise out of or relate to (1) creation of the Video Submission, (2) Entrant’s participation in the Contest, (3) use or misuse of the Prize, (4) any breach or violation of the Official Rules, or (5) any breach or violation of applicable law, regulation or policy, in each case whether or not caused partially or fully by the negligence of Cardone or any other Indemnified Party and whether or not the relevant claim has merit.
INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. If the Contest is not capable of running as planned for any reason, including without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify, or terminate the Contest. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Sponsor reserves the right to modify and amend these Official Rules from time to time for clarification purposes.
Limitations of Liability and Release
No liability or responsibility is assumed by Sponsor, its directors, officers, employees, agents, shareholders and affiliates (collectively the “Released Parties”) resulting from user's participation in, attempt to participate in, or download of any information in connection with participating in, the Contest. No responsibility or liability is assumed by the Released Parties for technical problems or technical malfunction, including, without limitation, those arising in connection with any of the following occurrences that may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet; unauthorized human or non-human intervention in the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; destruction of any aspect of the Contest; if the Contest cannot take place as planned, in whole or in part, or if the Prize cannot be awarded, due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, other labor disputes, fire, acts of government, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or other events outside of the reasonable control of the Sponsor (each a “Force Majeure Event”). The Released Parties are not responsible for any typographical errors in the announcement of the award or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. The Released Parties are not responsible for any personal injury or property damage or any other losses of any kind that may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site, or any other loss related to user’s participation in the Contest or receipt of any prize. As a condition of entering, Entrants agree (and agree to confirm in writing): (a) to release the Released Parties and each of them from any and all liability, loss, or damage incurred with respect to Entrant’s participation in the Contest and the awarding, receipt, possession, and/or use or misuse the prize; (b) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
Except where prohibited by law, by accepting the Prize, the winner grants permission for Sponsor and those acting under its authority to use their name, photograph or likeness, for advertising and/or publicity purposes, in any and all media, including but not limited to, posting on the Sponsor’s web site, social media sites and platforms now known or hereinafter invented without territorial or time limitations and without further notice to and without additional compensation.
Governing Law and Jurisdiction
This Contest is governed by US law and is subject to all applicable federal, state, and local laws and regulations. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, and Entrants agree that all claims and disputes must be resolved in the federal or state courts in Philadelphia, PA. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
